Lawyers of the Minority caucus in parliament have raised preliminary legal objections against the Greater Accra Regional Police Command’s injunction application against their planned protest against the Bank of Ghana Governor and his deputies.
According to the lawyers, on the face of the motion paper the application is irregular and should be struck out by the court.
Lead Counsel Godwin Edudzie Tamekloe argues that the signing of the motion paper by Superintendent of Police Sylvester Asare offends sections 19(a) of the state proceedings act and same ought to be struck out as defective.
Superintendent Asare while opposing to the preliminary objection said, the application before the court in competent and should be heard.
He prays the court to reject the request and hear their application seeking to injunct the minority from holding their protest.
EIB Network’s Legal Affairs Correspondent, Murtala Inusah who is in court is reporting that Justice Edward Twum has adjourned the case to Friday, September 8.
This means the protest by the minority tomorrow September 5 is in limbo.
However, the Minority in Parliament has rescheduled its planned protest against the Governor of the Bank of Ghana, Dr. Ernest Addison and his deputies to Friday, September 8.
This was after the Financial and Economic Division of the Accra High Court presided over by Justice Edward Twum heard preliminary objection raised by the minority.
The police had filed an application to injunct the protest over security concerns, but the Organiser on Monday, September 4, 2023 raised objections to the motion (a day before the planned protest).
The minority’s lawyers led by NDC’s Director of Legal Affairs, Godwin Edudzi Tamakloe, raised objection to the capacity of the Police to institute the action on their own accord.
