Legal practitioner, Samson Lardy Anyenini, has expressed disagreement with the court’s decision on the New Patriotic Party’s (NPP) Walewale constituency parliamentary primary election re-run.

This comes on the back of the Tamale High Court order for the re-run of the disputed NPP parliamentary primaries election for the Walewale constituency.

The judge, who is yet to deliver the fully written judgment, has instructed the second defendant and third defendant to conduct the re-run in accordance with electoral laws.

Mr. Lardy Anyenini, legal counsel for the first defendant, expressed disappointment with the court’s judgment.

Speaking to the media after the ruling, Mr. Anyenini argued that the plaintiff, Lariba Zuweira, was found to have impersonated dead voters and absentees, and therefore should not have benefited from the court’s decision.

He stated, “Our point at law was that if you commit a crime, you will not benefit from your crime.”

Mr. Anyenini highlighted that the evidence presented in court, including documentary and telephone records, proved that Lariba Zuweira was the one who paid people to impersonate voters. He said, “The law is that if you commit a wrong you must not benefit. So our expectation was that the court would say yes we found that it happened but the person who did that is the one who has come to court, the plaintiff, so she must suffer and not get a judgment in her favor.”

Mr. Anyenini expressed disappointment with the court’s decision, stating, “Our view is that the judgments do not correspond with the evidence that was led, the documentary and the telephone conversations that were attached and proving that it was the woman, the plaintiff, who paid these people.” He added that they will wait for the court’s reasons for the decision, scheduled for September 12, before advising their clients accordingly.

Mr. Anyenini concluded, “Wait until the 12th to get copies of the reason judgments and then the records, and then we will advise our clients accordingly. Our client has already indicated he’s a good sportsman even though the two who organized the election and also supervised the election didn’t come to court he was forced to be here and he has come to do what he has to do.”
