The Commercial Division of the Sekondi High Court presided over by His Lordship Justice Gyan-Kontor, has on Monday, November 11, lifted the injunction on the National Democratic Congress (NDC) Amenfi Central Parliamentary Candidate, Joana Gyan Cudjoe.
The National Democratic Congress (NDC) had filed a new writ at the Sekondi High Court after the EC refused to recognize Joana Gyan Cudjoe as the duly elected NDC candidate for Amenfi Central.
This was despite a prior High Court ruling in Sekondi on May 13, 2024, which had ordered that Cudjoe be acknowledged as the legitimate candidate.
On Monday, the Sekondi High Court, under Justice Gyan-Kontor, vacated the injunction, directing the EC to include Joana Gyan Cudjoe in the Notice of Poll. This allows her to officially contest the Amenfi Central parliamentary elections.
The Electoral Commission of Ghana had previously disqualified Joana Gyan Cudjoe, the NDC candidate for Amenfi Central, from the 2024 parliamentary elections. This action followed an Order for Interlocutory Injunction issued by the Sekondi High Court on May 31, 2024, in the case of Gyedu Frimpong & 4 Others versus Joana Gyan Cudjoe, the NDC, and the EC.
The order had restrained Joana Gyan Cudjoe from presenting herself as the duly elected NDC parliamentary candidate for Amenfi Central until a final determination of the case. Additionally, it prohibited the NDC and the EC from recognizing her as the candidate or affording her any associated rights or privileges.
However, in a ruling on Monday, Justice Gyan-Kontor vacated the injunction, instructing the EC to include Joana Gyan Cudjoe in the Amenfi Central elections.
Lawyer Edudzi Tamakloe, counsel for the first defendant, urged the EC to follow the court’s directive after the proceedings.
Joana Gyan Cudjoe, elated after the court proceedings, expressed relief that the albatross has been removed.She urged her supporters to intensify their campaign efforts to secure a victory on December 7.
