The Supreme Court has for the second time ordered lawyers of the Petitioner in the 2020 Election, John Mahama to file his witness statement by Wednesday, January 27, 2021.
The apex court panel of seven presided over by Chief Justice Kwasi Anin Yeboah arrived at this decision after it took strong exception to their refusal to respect an earlier order to file the witness statement.
The court establishing the premise to its decision said all the parties complied with the orders given by the court except the petitioner.
The court said, it does not appreciate the steps so far taken by the petitioner and let alone granting them audience.
Justice Anin Yeboah’s panel said it was imperative that the orders given by the court are complied with before anything else.
The court, however, warned that per the dictates of the Order 69 of CI 16 and CI 99 the court has the power to impose sanctions including striking out the petition.
The court said, should the petitioner fail to file witness statement and processes order, the court will impose the punishment as per the rules.
The case has been adjourned to Thursday, January 28, 2021 for hearing.
Earlier, Justice Samuel Marful-Sau, Justice Yaw Appau, Justice Prof Ashie Kotey, Justice Gertrude Torkornoo all members of the panel took strong exception to the actions of the petitioner with Justice Yaw Appau for instance, questioning why the court should hear the petitioner’s stay of proceedings when they have not complied with their orders.
