The Chief Justice together with the General Legal Council (GLC) and the Judicial Secretary have been sued by a private legal practitioner over a Circular to all Courts not to grant him audience.

Kwame Aning Fosu-Gyeabour, who is the Plaintiff per the suit filed on February 22, 2024 contented that, the GLC, the CJ and the judicial Secretary acted unlawfully in their circular to the courts not to grant him audience.

The Plaintiff claims against the Defendants; a declaration that the Circular issued by the defendants on February 16, 2024 is false, unlawful, illegal, irregular, ultra vires, unfair, capricious, arbitrary, unconscionable, unreasonable, in breach of rules of Natural Justice, unconstitutional and therefore a nullity.

Lawyer Fosu-Gyeabour whose license is said to have not been renewed is also seeking an order setting aside the said circular issued by the defendants.

The Plaintiff is also asking for a “perpetual injunction restraining the defendants herein, their assigns, agents, officers or any persons authorized by them from preventing plaintiff from having access to the courts to practice his trade as a lawyer without due process or from unlawfully interfering in any manner the plaintiffs practice as a lawyer and operation of his law firm.”

He is also asking for General Damages, Cost inclusive of legal fees and any other reliefs that may be just.

Circular to all Courts

On February 16, the GLC sent a circular to all courts through the Judicial Secretary who also doubles as the Secretary to the GLC, Justice Cyra Pamela C.A. Koranteng, (a Justice of the Court of Appeal), said the Plaintiff’s license has not been renewed and therefore should not be granted audience m.

“Kindly take note that Mr. KwameAning Fosu-Gyeabour’s license has not been renewed for the year 2024,” the Circular stated.

“All Courts are therefore not to grant him an audience until further notice from the General Legal Council.

“The Honourable Lady Chief Justice and Chairperson of the General Legal Council has further directed that any order issued on Mr. Kwame Aning Fosu-Gyeabour’s application will be void.

“Please accept the compliments of the Honourable Lady Chief Justice and Chairperson of the General Legal Council and take note accordingly,” the Circular concluded.
