The Minority in Parliament have hinted they will challenge the decision by the government to create a special prosecutor’s office.
According to the minority, the move will be a breach of Ghana’s constitution.
The Akufo-Addo-led administration promised the creation of a special prosecutor’s office during the 2016 elections. The President believes such an independent prosecutor will be able to deal with corruption cases without biases in the public sector.
The attorney general-designate Gloria Akuffo told parliament during her vetting that the government is keen on creating the portfolio to deal with graft.
Speaking to the media on the issue after the vetting, Minority leader Haruna Iddrisu said the minority will challenge the decision at the Supreme Court, if need be.
“..You cannot create this without tinkling with article 88 of the constitution. And article 88 belongs to the executive chapter of the constitution, and that is entrenched. Therefore you cannot be seeking to review that through an act of parliament; that will be to come through the window to seek to amend a constitutional provision. We will subject that proposition to strict legal test, if it includes examining it and considering a legal pronouncement at the highest level of the Supreme Court,” Mr. Iddrisu argued.
