A three-member panel of the Court of Appeal presided over by Justice Philip Bright Mensah has set aside the ruling of the High Court presided over by Justice Kwasi Anokye Gyimah to conduct the Opuni trial afresh.
The panel which also includes Justice Ernest Owusu-Dapaah and Justice Jennifer Dadzie in their unanimous decision ruled that, the High Court judge misdirected itself (powers) to have made that determination.
Justice Anokye Gyimah who was assigned the brief following the retirement of Justice Clemence Honyenuga (Retired) on April 4, this year, ruled that the trial will start De Nove (afresh) to enable him among other things observe the demeanor of witnesses.
Dissatisfied with the decision, the Attorney General Godfred Yeboah Dame appealed against the decision.
Ruling on the appeal on Monday July 3, the Court of Appeal in its unanimous decision said the proceedings of retired Justice Clemence Honyenuga’s be adopted by the High Court differently constituted.
EIB Network’s Legal Affairs Correspondent, Murtala Inusah, reports that a new judge is expected to take over the case as Justice Anokye Gyimah has been transferred.
