The opposition National Democratic Congress(NDC) is confident a new bench of Supreme Court Justices will overturn the judgement on the annulment of the election of James Gyakye Quayson as Member of Parliament for Assin North.
It follows the release of the Apex court’s full reasoning released on Monday, June 5, 2023.
Reacting to the Judgment in an interview on Starr FM, the Director of Legal Affairs for the NDC, Abraham Amaliba noted that the judgment failed to consider other relevant laws.
“…What punishment are you giving to the Electoral Commission, I raised this issue by saying that then it will mean that the Electoral Commission misled Gyakye Quayson. Because the EC invited him and he justified his stance and they allowed him to contest and so merely saying they acted unconstitutional and now you are punishing the one who merely was acting upon the direction of the EC, is that fair. Did the EC connive, did the EC also abet the commission of that crime? They need to get their acts right. But this judgement I am sure one day another batch or set of Supreme Court Judges will overturn it, that’s my view.”
The Supreme Court on Monday, June 5, made its 35-paged judgement that ordered Parliament to expunge James Gyakye Quayson’s name as Member of Parliament for Assin North available to the interested parties in the case.
The Supreme Court in a unanimous decision about a fortnight ago ordered Parliament to expunge the name of James Gyakye Quayson from its records.
The Apex Court presided over by Justice Jones Dotse ruled that the Electoral Commission (EC) acted unconstitutionally in allowing the beleaguered Assin North MP to contest the 2020 parliamentary elections with no proof of him renouncing his Canadian Citizenship.
The plaintiff, Michael Ankomah-Nimfah filed the application following a judgment he secured at the High Court in Cape Coast injuncting Gyakye Quayson from holding himself as MP.
This is after the court ruled that by being a Canadian citizen, he was not qualified to contest as an MP in Ghana.
