The Human Rights (Division) of the High Court in Accra has granted an oral request for extension of time to file written submissions by lawyers of Charles Bissue in an action that, his client is seeking an enforcement of his fundamental human rights against the Office of the Special Prosecutor.
This was after Nana Agyei Baffour Awuah, Counsel for the former Secretary to the Inter-Ministerial Committee on Illegal Mining (Applicant) said he was hampered by an injury he suffered to his leg during the period.
Justice Nicholas Mensah Abodakpi had on December 6, 2023 directed the parties to file their respective written submissions before Monday, January 15, 2024 for the case to be heard.
But, Counsel for the Applicant who appeared in court on clutches, prayed for a short adjournment to be able to file his client’s written submission.
State Attorneys were also directed to ensure that, they serve their processes on the other parties.
Justice Abodakpi said, the playing of the video contained on a pendrive which is part of Charles Bissue’s case, however, could not be done Monday.
The case has been adjourned to February 1, 2024.
Subject matter
Charles Bissue who is seeking for the enforcement of his human rights is asking for the following relief from the Human Rights;
a). Quash or cancel the Arrest Warrant issued against the Applicant by the 2nd Respondent to the 1st Respondent.
b). Quash the 1st Respondent’s Notice, declaring the Applicant wanted.
c). Compel the 1st Respondent to comply with the provisions of L.I. 2374 by providing the Applicant with a copy of the Petitions, forming the basis of the investigations being conducted by the 1st Respondent in respect of which the Applicant is deemed to be a necessary person.
d). Prohibit the 1st Respondent, pending the determination of Suit No. J/0328/2023, from applying for Arrest Warrants and hounding the Applicant in the name of investigations.
