Member of Parliament for Old Tafo, Vincent Ekow Assafuah, has filed a fresh application at the Supreme Court seeking to halt President John Mahama’s warrant to suspend Chief Justice Mrs. Gertrude Sackey Torkornoo.
The application for an interlocutory injunction, filed on April 24, seeks two main reliefs following the Chief Justice’s suspension on April 22.
The application reads: “PLEASE TAKE NOTICE that this Honourable Court will be moved on a day appointed by the Registrar at 9 O’clock in the forenoon or so soon thereafter as Counsel for and on behalf of the Plaintiff/Applicant may be heard on application praying for the following orders:
- An order restraining any step or action from being purportedly taken as part of the processes for the removal of the Chief Justice under article 146 or in any manner until the hearing and final determination of the instant action;
- An order suspending the operation of the warrant for suspension of the Chief Justice purportedly issued by the President under article 146(10) of the Constitution, 1992, until the hearing and final determination of the instant action.
This is the second application filed by the MP, led by former Attorney General Godfred Yeboah Dame, since the petitions were made public in later part of March.
A previous application for an interlocutory injunction is scheduled for hearing on May 6.
