Attorney General files application to set aside travel order granted to Hanan Abdul-Wahab Aludiba

State cites new evidence and alleged attempted access to frozen funds in bid to revoke UK travel approval.

The Attorney General has on behalf of the Republic, filed an Application beforethe High Court to set aside an order granted on 29th June 2026 permitting Mr. Hanan Abdul-Wahab Aludiba, the first accused in a pending criminal trial, to travel to the United Kingdom for Specialist medical treatment.

The Application has been necessitated by material facts and subsequent developments that came to the attention of the Prosecution after the Court granted the travel request.

These developments, in the Attorney General’s considered view, fundamentally alterthe basis upon which the Court exercised its discretion.

Facts deposed to in the affidavit in support of the Application reveal that the first accused allegedly attempted to rely on an order of a differently constituted High Court in separate proceedings to access funds held in Bank accounts that remain subject tovalid freezing orders obtained by the Economic and Organised Crime Office (EOCO); an act which violates Section 37 of the Economic and Organised Crime Act, 2010 (Act804).

The relevant financial institution declined the attempted withdrawal and notified the investigative authorities. This attempted withdrawal occurred shortly before the first accused was due todepart Ghana, raising legitimate concerns regarding compliance with existing court orders,the integrity of the ongoing criminal proceedings and the risk that the accused may fail to return to stand trial if permitted to leave the jurisdiction.

It is the position of the Attorney General that these material facts which were not before the Court when the travel order was made may materially influence the Court’s decision regarding itsorder granting leave for the first accused to travel outside the jurisdiction.

The Attorney General has therefore taken the earliest opportunity to submit these developments tothe Court respectfully inviting it to reconsider its earlier order in the interest of justice.

The Office wishes to emphasize that this Application is part of the ordinary legal processes available under Ghanaian law where applications may be brought in instances where there are material changes in circumstances after a judicial order.

The application does not seek to prejudge the substantive issues before the Court as the first accused continues to enjoy the constitutional presumption of innocence until proven guilty by a court of competent jurisdiction.

Following his arrest, Mr. Hanan Abdul-Wahab Aludiba has since been granted bail by EOCO.
As the matter is pending before the High Court, the Office will make no further comments.

The Office of the Attorney-General remains committed to upholding the rule of law, protecting the integrity of criminal proceedings and ensuring due process for all accused persons, while safe guarding the administration of justice.
