Lawyers of Charles Bissue, the Secretary to the defunct Inter-Ministerial Committee on Illegal Mining (IMCIM), has had one of his three applications for interlocutory injunctions against the Office of Special Prosecutor (OSP) struck out.
This was after his lawyers indicated to the court their willingness to withdraw the application
Charles Bissue had filed various applications including this case in which he had asked the court to restrain the OSP’s investigations or direct that investigative journalist Anas Aremyaw Anas be included as a suspect.
He had earlier secured a 10-day interim restraining order against the OSP for his arrest at the Human Rights Coury but has since turned himself to the OSP and has been granted bail.
In court on Thursday, June 22, a member of his legal team Nana Kojo Pintoh Gyabi told the court that, “we intend to discontinue this suit filed on June 9, 2023 and all the attached processes.
Dr. Isidore Tufuor, Counsel for the OSP said this was “their own application,” and “if they intend to withdraw it, we are not opposed to it.”
He however waived his rights to ask for cost.
The High Court in Accra presided over by Justice Abena Amponsah Buansi after listening to the parties struck out the application as withdrawn.
In his application, he had also asked the court to restrain the OSP from effecting his arrest.
The Investigative agency’s probe was triggered by a documentary published by journalist Anas Aremyaw in which Mr. Bissue was allegedly filmed receiving bribes.
Currently, there are two other cases filed by Mr. Bissue pending at the courts against the OSP at the Human Rights Court and also at the General Jurisdiction 4 of the Accra High Court.
