The Professional Association of Psychiatric Nurses- Ghana (PAPNG) has secured an interim injunction against the implementation of a collective agreement for nurses by the labor division of the Accra high court.
The PAPNG is challenging the legality of the collective agreement that takes effect on July 1 on the allegation that the Ghana registered nurses and midwives associated, GRNMA, solely negotiated the agreement a contravention of the Labour Act, 2003 (Act 651).
The group adds that, the Ghana registered nurses and midwives associations did not seek the consultation of PAPNG and other relevant stakeholders such as UPNMG during the decision hence a decision to seek an ex parte injunction on the agreement.
“IT IS HEREBY ORDERED that the 1st Defendant/ Respondents herein, its Assigns and Agents are restrained from implementing the Collective Agreement on 1st July, 2024.”, the court ordered after hearing the motion moved by lawyers of the PAPNG.
Meanwhile, the association has praised the high court for what it describes as a fair ruling.
“This ruling is a significant victory for psychiatric nurses across Ghana. It upholds the principles of fairness and inclusivity in collective bargaining processes, ensuring that the voices of all relevant unions are heard and respected”, the association said in a statement.
PAPNG, however, adds that it will not compromise in the fight for the fair treatment of its members
“We remain committed to advocating for the rights and interests of psychiatric nurses and will continue to work towards ensuring fair and equitable treatment for all our members.”
PAPNG secured the injunction against The Ghana Registered Nurses and Midwives Association, Fair Wages and Salaries Commission, The Controller and Accountant General, The Minister for Finance and The Attorney General.
