The Supreme Court will on Thursday, January 23, 2025, hear applications for Certiorari and prohibition filed by the National Democratic Congress’s (NDC) four Parliamentary Candidates seeking a reversal of orders by the High Court to the Electoral Commission (EC) to collate and declare results of four disputed constituencies.
Though the orders of the High Court in respect of the orders have been carried out in three out of the four constituencies – Tema Central, Okaikwei Central, and Techiman South with Ablekuma North suspended, the NDC wants the orders authorizing the EC through Nandamus applications reversed.
The applications are seeking a Judicial Review in the nature of Certiorari to nullify Justice Forson Baah Agyepong’s (High Court judge) decision to overrule their objection against the jurisdiction of the Court to hear the Mandamus application on January 1, 2025, and the subsequent orders to EC to collate outstanding polling center results and declare winners on January 4, 2025.
The processes at the Supreme Court were filed on January 6, 2025 moments after the High Court in Accra was forced to adjourn the hearing of their Application for Stay of Execution pending appeal.
In a related development, the Akwatia Constituency Parliamentary dispute in which the High Court in Koforidua placed an interim injunction on the swearing-in of Ernest Yaw Kumi, MP-elect for the Akwatia Constituency would also be heard by the apex Court on the same day.
The hearing date has been confirmed through the Cause List of the week starting from Tuesday January 21 to January 23, 2025 and signed by the Supreme Court registrar.
