Court picks Registrar General to oversee GFA dissolution

The Registrar of Companies has been given the green light to act as the official liquidator of the Ghana Football Association (GFA).

The High Court on Thursday, 12 July 2018 also granted an injunction application by the Attorney General to restrain executives of the Ghana FA and its assigns from working in an official capacity.

At the last court sitting, the Ghana FA was granted leave by the Commercial High Court to file an affidavit to oppose a motion filed by the Attorney General, Gloria Akuffo, seeking an interlocutory injunction to stop Executives of the GFA from carrying out their duties until the court determines the State’s case asking GFA to be liquidated.

In his ruling, the Presiding Judge indicated that the claim by lawyers of the GFA that the application by the Attorney General is frivolous is untenable. The application he said has substance and right in law. He therefore went ahead to grant the application and also appointed the Registrar General as the official liquidator to oversee the processes leading to the winding up of the GFA.

The FA boss Kwesi Nyantakyi has been banned by world’s football governing body FIFA over allegations of conflict of interest and bribery after being caught on secret camera allegedly accepting gift contrary to football rules.

Justice Samuel Kwame Asiedu in his ruling said he has no issue with the grounds of the Attorney General and has since given the Registrar General Jemima Oware powers to manage the assets of the GFA until the hearing of the substantive petition for liquidation.

The AG after initially securing a 10-day injunction against the GFA filed a new application which was granted to also take over of the assets of the football powerhouse.

Background

The Attorney General headed to court on Tuesday, June 12, 2018 to dissolve the Ghana Football Association (GFA) following an explosive revelation against the football powerhouse.

The former president of the FA Kwesi Nyantakyi is currently on a police enquiry bail after being captured on tape receiving $65,000 gift to agree a sponsorship deal with supposed investors in an undercover investigation by celebrated journalist Anas Aremeyaw Anas.

He resigned on Friday, June 8, after FIFA handed him a 90-day provisional ban from all footballing activities.

Over 80 referees and football officials were involved in the bribery scandal which has rocked the GFA.
