The Majority Caucus in Parliament is demanding that Speaker Alban Bagbin immediately declare the Kpandai parliamentary seat vacant, following a Tamale High Court decision that nullified the 2024 election results in the constituency.
The court, in its ruling delivered earlier this week annulled Matthew Nyindam’s victory after determining that irregularities materially affected the outcome of the poll.
The judge subsequently ordered the Electoral Commission to conduct a fresh election, effectively stripping the MP of his mandate until the rerun is held.
Despite being formally notified of the judgment, the Majority insists Nyindam continues to take part in parliamentary business—an act they say contradicts established precedent.
Raising the matter on the floor, Majority Chief Whip Rockson Nelson Dafeamekpor argued that Parliament had acted differently in a similar situation.
He recalled the 2023 case involving then-Assin North MP James Gyakye Quayson, who stepped aside after a court ordered a by-election.
“This is a path that we have travelled,” he said. “Mr Speaker, when the Honourable Gyakye Quayson was ordered by the court that he should go through re-run, Members of this side at the time, mainly led by the now Minority Leader, spoke vociferously against the fact that the Honourable Gyakye Quayson cannot be entertained in this house.”
The Majority is therefore urging the Speaker to enforce the court’s directive, declare the seat vacant, and prevent Nyindam from participating in parliamentary proceedings until the rerun is completed.
