Mahama dismisses petitions for removal of EC, deputies, and Special Prosecutor after CJ finds no prima facie case

President John Dramani Mahama has dismissed all petitions seeking the removal of the Electoral Commission Chair, her deputies, and the Special Prosecutor after the Chief Justice found no prima facie case.

The Chief Justice of Ghana, Justice Paul Baffoe-Bonnie, has informed President John Dramani Mahama that no prima facie case exists in petitions seeking the removal of the Chairperson of the Electoral Commission, her deputies, and the Special Prosecutor.

President Mahama had referred the petitions to the Chief Justice on November 25, 2025, following submissions from several individuals and groups alleging misconduct, cronyism, abuse of office, and gross incompetence against EC Chair Jean Adukwei Mensa, Deputy Chairpersons Dr. Bossman Eric Asare and Samuel Tettey, and Special Prosecutor Kissi Agyabeng.

The petitions, which cited multiple counts of alleged misbehaviour, claimed that the officials’ actions undermined public confidence in the Electoral Commission and threatened the credibility and independence of Ghana’s electoral process.

A statement on February 18, 2026 and signed by Spokesperson to the President, Felix Kwakye Ofosu, said, “By a letter dated 26th January 2026, the Chief Justice informed His Excellency the President that no prima facie case has been established by the petitions to warrant any further investigations for the removal of the Electoral Commissioner, Deputy Commissioners and the Special Prosecutor.”

The dismissal ends preliminary review proceedings and confirms that the officials will continue in their respective roles, with no further investigation required at this stage.

This outcome follows seven petitions against the Electoral Commission leadership and three against the Special Prosecutor, all referred under Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959).
