Lawyers of embattled former Chief Executive Officer of NAFCO, Hanan Abdul-Wahab Aludiba, led by former Attorney General (AG) Godfred Yeboah Dame, have filed a notice of motion for an order of Habeas Corpus at the High Court.
The application seeks to compel the AG and the Director of the Bureau of National Intelligence, BNI, to produce Abdul-Wahab, who has been in BNI custody since July 4, 2026.
According to the motion filed on Monday, July 6, 2926 pursuant to the 1992 Constitution and the Habeas Corpus Act, 1964 (Act 244), the lawyers are asking the court to direct the BNI to produce the body of their client.
They are also seeking an order for the respondents (AG and BNI) to comply with a previous court order dated June 29, 2026, which granted leave to the applicant to travel out of the jurisdiction.
The case has been listed for hearing on Friday, July 10, 2026.
Counsel for the 1st Accused/Applicant, Godfred Yeboah Dame and his team, argue that the continued detention of Abdul-Wahab without compliance with the June 29 order necessitates the intervention of the court.
On Saturday, July 4, Deputy Attorney General, Dr. Justice Srem-Sai confirmed the arrest of Hanan Abdul-Wahab Aludiba at t the Accra International Airport on his Facebook page as follows;
“Law enforcement officers have, a while ago, arrested Mr HANAN ABDUL-WAHAB ALUDIBA at the Accra International Airport.
“MR ALUDIBA, who is currently standing trial for stealing and causing financial loss to the Republic, was granted leave by the trial High Court to travel to the UK for a few days.
“It was, however, MR ALUDIBA’s attempt to use false means to empty his frozen bank account with Republic Bank on Thursday which occasioned tonight’s arrest.
“The learned Attorney-General will, on Monday, seek a review of the court order which granted MR ALUDIBA leave to travel out of the country.”
