Former Director of the Ghana School of Law, Kwaku Ansa-Asare, has advised the Supreme Court to disregard further injunctions challenging the suspension of the Chief Justice Gertrude Torkornoo.
He is calling on the Supreme Court to take decisive action and assert its authority by putting an end to what he says are frivolous and repetitive applications.
Justice Torkornoo on Wednesday, May 21, filed a suit at the Supreme Court seeking an interlocutory injunction to halt the proceedings of a committee set up by President John Dramani Mahama to investigate several petitions seeking her removal from office.
The suit also seeks to exclude Justices Gabriel Pwamang and Samuel Kwame Adibu-Asiedu from the committee on the grounds of perceived bias.
It further calls for a complete halt to the committee’s work, which includes former Auditor-General Daniel Yao Domelevo, Major Flora Bazwaanura Dalugo, and Professor James Sefah Dzisah.
However, Mr. Ansa-Asare has described the move as a poorly advised and counterproductive strategy.
Speaking on Morning Starr with Naa Dedei Tettey, he said the repeated court filings on the same issue amount to judicial abuse and could undermine public confidence in the legal system.
He urged the Supreme Court to take a firm stance to prevent further abuse of its processes.
Mr. Ansa-Asare said, “Well, you see, yes and no. Yes, they may sit because they’ve thrown out at least four already, but no, because, you know, other injunctions were pending. So I expect the Supreme Court to decisively rule that any intended application shall abide by the rulings they have already made, and we end the matter.”
He warned that the integrity of the judiciary must be safeguarded and cautioned public officials, especially those in the legal system, against weaponizing the courts for personal defense.
