The Supreme Court has indefinitely adjourned the hearing of an application by the National Democratic Congress (NDC) seeking to overturn the ruling of the High Court that ordered the Electoral Commission (EC) to complete collation in Tema Central, Okaikoi Central, Ablekuma North, and Techiman South Constituencies following a Mandamus Application.
Though the commission has since completed the collation in three of the four constituencies with the exception of the Ablekuma North and declared the NPP candidates winners, the NDC is praying the Apex Court to reverse the decision of the High Court judge dated January 4.
They application is challenging the jurisdiction of the High Court to hear the application for mandamus and the subsequent orders that followed.
The application (for Certiorari) at the Apex Court filed by the NDC and its four parliamentary candidates is seeking to reverse High Court’s orders on January 1 and 4.
The January 1 decision they are challenging is in relation to a preliminary legal objection which was over ruled and the January 4 bothers on the grant of the Mandamus Application and it’s related orders to the electoral commission to collate outstanding polling station results and declare winners of four disputed seats.
The affected constituencies are – Tema Central, Okaikwei Central, Ablekuma North and Techiman South following the grants of some Mandamus Applications filed by the New Patriotic Party’s Parliamentary Candidates.
In Court on Thursday, January 23, 2025, a five member panel presided over by Justice Gabriel Pwamang adjourned the case sine die (indefinitely).
This was after it emerged in court that the NPP Candidates (the interested parties in the application) had not been served with the processes.
The panel which also includes Justice Prof. Henrietta Mensa-Bonsu, Justice Ernest Gaewu, Justice Henry Anthony Kwofie and Justice Richard Adjei-Frimpong adjourned the hearing Sine die.
Meanwhile, some supporters of the NDC specifically in the Ablekuma North Constituency expressed disappointment over the adjournment of the case.
