The Member of Parliament for Bongo, Charles Bawadua, has described the Supreme Court ruling that upheld the victory of Kpandai MP Matthew Nyindam as a technical one that does not address the core electoral issues.
Speaking on GHOne TV with Serwaa Amihere on Thursday, February 19, Bawadua congratulated Nyindam but questioned the basis of the court’s decision.
“The manner the victory came dilutes its significance,” he said.
According to Bawadua, the ruling focused on procedural grounds rather than the substantive allegations concerning the results at the polling stations.
“The victory did not deal with the substantive issue of whether or not he actually won at the polling stations or the allegations against him at the polling stations were not true. The victory was one of a technical victory to the effect that the processes had been filed out of time,” he explained.
He added that while legal technicalities are important, they can sometimes prevent what he described as “substantive justice.”
“Sometimes we may have to do away with some of these technicalities in order to do substantive justice. Now the people of Kpandai cannot see specifically whether or not my colleague won at the polling stations or he was saved by the technicalities of the case, and that is disturbing,” he stated.
Despite raising these concerns, Bawadua reiterated his congratulations to Nyindam for securing the Supreme Court verdict.
