The High Court in Accra has ordered the Attorney General to file full disclosures by June 2, 2025, in the case involving former National Signals Bureau (NSB) Director General Kwabena Adu-Boahene and three others over GHc49M theft.

The judge, Justice John Eugene Nyante Nyadu, stated that discussions on plea bargaining can only begin after the disclosures have been filed.

The court ordered: “The Attorney General is ordered to file disclosures not later than June 2, 2025. I further order the accused persons to only engage in any Plea Bargaining Agreement after service of disclosure processes.”

The prosecution had requested more time to complete their disclosure process, citing the unavailability of a key investigator who was indisposed.

Deputy Attorney General Dr. Justice Srem-Sai assured the court that the investigator would be available by May 30, 2025.

Dr. Srem-Sai explained: “By the proceedings of the last adjourned date (May 13, 2025), we were ordered to file our witness statements and disclosures by May 20, 2025. However, we could not comply with the deadline because one of our key investigators was indisposed; he was not available to sign the relevant documentation.”

Counsel for the accused persons, Samuel Atta Akyea, did not oppose the prosecution’s request, citing Article 88(3) of the 1992 Constitution, which gives the Attorney General responsibility for initiating and conducting all criminal prosecutions.

The court clarified that the third accused person, Mildred Donkor, had been admitted to court bail on May 13, 2025, on the same terms as her existing police enquiry bail.

Kwabena Adu-Boahene, 1st Accused, Angela Adjei Boateng, 2nd Accused, Mildred Donkor, 3rd Accused, and Advantage Solution Limited ( company) have been slapped with 11 charges including stealing.

They have all pleaded not guilty to the charges and are all on bail.

The case has been adjourned to June 11, 2025.
