Former Finance Minister Ken Ofori-Atta will not honour his scheduled appearance before the Office of the Special Prosecutor (OSP) today, Monday, June 2, due to a reported decline in his health condition, according to his legal representatives.
Reports from his legal counsel indicate that Mr. Ofori-Atta is currently in the United States receiving medical care, and his deteriorating health has made it impossible for him to return to Ghana.
According to his legal team, detailed medical records and an official notice of his condition have been submitted to both the OSP and the Human Rights Court.
The missed appearance has reignited public debate over whether the OSP, led by Special Prosecutor Kissi Agyebeng, will proceed to reclassify the former minister as a wanted person—a designation previously issued and currently being challenged in court.

Mr. Ofori-Atta is engaged in a legal battle at the Human Rights Court, seeking to overturn the OSP’s earlier decision to declare him wanted.
He is also requesting the removal of any public notices or social media posts by the OSP referring to him as a fugitive.
The court is expected to rule on the matter on June 18, 2025.
While the case is pending, Mr. Ofori-Atta has expressed his willingness to cooperate with investigators remotely.

His legal team has proposed that a virtual session be arranged under the Electronic Transactions Act to allow the OSP to take his Cautioned Statement while he continues to receive treatment abroad.
The OSP has yet to respond formally to this request or indicate whether it will pursue alternative legal avenues in light of his absence.
