A law Professor at the University of Ghana, Prof. Kwadwo Appiagyei-Atua, has accused state officials of violating the fundamental human rights of the former Director-General of the National Signals Bureau (NSB), Kwabena Adu Boahene, and his wife, Angela Boateng.
This comes after the couple was detained beyond the 48-hour detention rule following allegations of their involvement in the diversion of $7 million allocated for a cybersecurity project.
Speaking to Starr News, Prof. Appiagyei-Atua stated that regardless of the nature of the allegations, individuals must be treated in accordance with the law, with their constitutional rights respected and upheld.
“It is possible for a person to be rearrested, depending on the information or evidence available suggesting that the individual may not be appropriate for release or that their release is not in the best interest of the state. However, this must be properly justified. Each case must be considered individually, and decisions must be based on gathered evidence or information that supports such conclusions. The law permits such actions when supported by sufficient grounds.”
“Furthermore, the fundamental human rights of Mr. Adu Boahene have been violated by state officials. The accused has the right to access their lawyer and communicate confidentially with them, which must always be respected,” he added.
