The Supreme Court has quashed an order by the High Court directing the Ghana Immigration Service (GIS) to restore the residence and work permit of Indian businessman Askok Kumar Sivaram.
Mr. Sivaram was deported on June 1, 2017, upon a directive issued to the GIS by the Interior minister Ambrose Dery.
According to the deportation order, he “acquired and submitted a forged marriage certificate in support of his application for citizenship by registering as a Ghanaian in 2015.”
In a July 31, 2017 ruling, the High Court presided by Justice Kwaku Ackaah Boafo declared the deportation of Mr. Sivaram as illegal.
According to Justice Boafo, the Interior Minister exceeded his jurisdiction when he issued the deportation order quashing and declaring the deportation order as null and void.
Following this ruling, the High Court being presided by Justice Naa Adele Azu on August 25, 2017 ordered the GIS to give Mr.Sivaram a temporary residence permit—an order the Supreme Court sets aside Thursday March 8, 2018.
Justice Azu, according to the Supreme Court erred in granting the order of mandamus and exceeding her jurisdiction in the process.
It further added that mandamus could not be granted in Mr. Sivaram’s situation when he did go through the administrative process of getting the revocation residence and work permit addressed.
