South Tongu: Lotto writer jailed for defiling a 6-year-old child

The Dabala Magistrate Court in the South Tongu District of the Volta region has sentenced a 30-year-old man to 10 years imprisonment.

Sampson Xormenyo Yitifle, a lotto writer and a resident of Akalove was convicted for defiling a 6-year-old girl in a trial that lasted for more than a year.

Case briefs

Presenting the facts, the prosecution led by D\PW\Inspr. Elikplim Avorgbedor told the court that “the accused who resides at Akalove, on Sunday 8th January, 2023 lured the victim with a saloon mango into his room and had sexual intercourse with her.”

According to the prosecution, the victim after her breakfast that morning, set out to play with her friends across the street, opposite her house but was left alone at some point when the other child she was playing with went home to bath.

The court heard that Sampson (the accused) who lives within the vicinity took advantage of the situation and called the victim to come for mango but lured the little girl into his room where he defiled her and released her later.

Luck, however, eluded the accused when his own elder brother spotted the victim leaving the compound with tears in her eyes.

He questioned the victim and led her home where the victim opened up on her ordeal to her family who would later report the incident to the Chief’s palace.

The accused person who appeared before the Chief when he was summoned was taken to the Dabala police station together with the victim and her family where a formal complaint was logged.

The prosecution told the court that, “upon receiving the complaint, the complainant was issued a police medical form to take the victim to the hospital for examination and treatment.”

The accused person was, however, re-arrested, cautioned and later charged with the offense of defilement contrary to Section 101 of the Criminal Offenses Act 29/60 as amended by Act 554, Section 11.

        Trial

Though the accused person pleaded not guilty to the charge when he appeared in court, the court was presided over by His Honor Mr. Joseph MacAli Jnr. found him guilty after the full trial and sentenced him to 10 years imprisonment.
