Trader jailed 150 days for threat of harm after pleading guilty

A 29-year-old trader, Osman Boustani, has been sentenced to 150 days in jail after pleading guilty to the charge of threat of harm, a year after his arrest.

Boustani, had earlier pleaded not guilty when he was first arraigned but changed his plea a year after.

The Circuit Court in Accra presided over by Her Honour Mrs Evelyn Asamoah convicted him on his own guilty plea and sentenced him accordingly.

Following a plea of mitigation by his lawyers and prosecution’s response to the mitigation factors by Chief Inspector Amoah Richard, the accused was sentenced to a term of 150 days imprisonment.

It was the case of the prosecution that, the Complainant, Yussif Iddrisu, is a trader who deals in Africa wears at a place opposite Ghana Commercial Bank on the Oxford Street Osu, whilst the Accused Osman Boustani is also a trader and a resident of Oxford Street Osu.

Chief Inspt. Richard Amoah told the court that, on May 9, 2022 about 3:00 pm, accused parked his vehicle by the roadside on the Osu Oxford Street where Complainant had displayed his Africa wears for sale.

The Prosecutor said the Complainant approached the accused and pleaded with him to move a little forward to enable pedestrians have clear view of his displayed goods.

He told the court that, the Accused never adhered to the humble request made by the complainant but rather became offended and insulted the complainant with a threat to beat him up.

The Prosecutor said, the Accused alighted from his vehicle apparently to beat the complainant but people at the scene intervened and stopped him from executing his intention.

He said, the Accused returned to his vehicle and moved away his vehicle but a few minutes later, accused returned to the scene holding a sword and brandishing same on the ground amidst threat to kill the complainant.

Chief Inspt. Amoah said, the Complainant together with one other escaped into a nearby jewelry shop to seek refuge.

“The accused followed the complainant to the shop where he had sought refuge and continuously used the sword to hit the door but could not gain access to the shop because the door was locked,” the Prosecutor told the court.

“Accused after a while left the scene and complainant left the shop to Osu police station and reported the matter.

“Accused was arrested and during investigation the sword retrieved from the room of accused where the accused concealed the sword in a stuffing chair,” the Prosecutor stated.

It was after investigation, that the accused was charged and put before before court.
