A Private Legal Practitioner Abraham Amaliba is demanding a review of the membership of the General Legal Council’s Disciplinary Committee to exempt Supreme Court Judges.
He argues that the judges serving at the superior court are parties in any appeal brought before them due to their positions on the disciplinary committee of the legal system’s regulator.
His calls followed the quashing of the three-year ban the General Legal Council (GLC) slapped on renowned Lawyer Francis Sosu by the Human Rights Court 1 Wednesday.
The Court presided by Her Ladyship Justice Gifty Agyei-Addo also set-aside the one year mentorship handed to the Human Rights lawyer.
The General Legal Council (GLC) in June 2017, barred the prominent lawyer from practicing as a lawyer after he was found guilty of professional misconduct.
It followed a complaint filed at the Council by one of his clients, Francis Agyare, who accused Mr. Sosu and his law firm F-X Law & Associates of attempting to swindle him.
The integrity of the GLC has been questioned after the Court presided by Her Ladyship Justice Gifty Agyei-Addo overturned the three-year suspension imposed on Mr. Sosu.
Speaking to Starr News Mr. Amaliba observed that the GLC in its current composition has demonstrated that it cannot be objective.
“You realised that most of the time when people are affected by the General Legal Council and they go to the court they are able to overturn the ruling of the General Legal Council and so this is supposed to be a self-introspection for members of the General Legal Council,” he stated.
He added “the processes are still open for an appeal…and that some of us have indicated that the issue of having superior court judges particularly, Supreme Court judges, sitting in the General Legal Council and determining the fate of lawyers should be a thing of the past.
“If Sosu had lost the matter at the High Court he would have appealed to the Courts of Appeal and proceed to the Supreme Court where he will meet the same judges who took the decision against him.”
