Lawyers of Gregory Afoko have been directed to properly serve the Attorney General’s Department with their application seeking a stay of proceedings at the Accra Central Magistrate Court.
In court Monday, Benedicta Antwi lawyer for Afoko who held brief for the substantive lawyer Osafo Buabeng informed the court that, they have filed an application at the Supreme Court for an order for the state to go back to the High Court to continue with the earlier trial.
This was after the state had filed a Nolle Prosequi to stop the case at the High Court following the arrest of Asabke Alangde in the case in which New Patriotic Party Upper East Chairman Adams Mahama lost his life.
The lawyers while praying the court to stay proceedings pending the determination of the application at the apex court contended that Afoko has not been discharged by the High Court since they have not seen any discharge order.
Lilly Atutiga, the representative of the Attorney General in her response said the defence counsel should come properly if it intends to stay proceedings.
She said, they should serve the AG for it to respond to their application. She said they cannot just write a letter to the registrar expecting stay of proceedings and copy the Director of Public Prosecution.
She described the manner the defence was seeking stay as ambushing since there was no affidavit in support.
The court magistrate Ms Efua Sackey, however, directed the defence to serve the AG with their application seeking fro stay of proceedings.
Daily Heritage Court Correspondent Muntalla Inusah who was in court reported that the case has been adjourned to February 27, 2019.
