A nine member panel of the Supreme Court presided over by the Chief Justice Gertrude Araba Esaaba Sackey Torkornoo has dismissed an application seeking to injunct the Speaker from allowing the LGBTQ+ bill until the determination of a substantive suit challenging the bill at the Supreme Court is determined.
Dr. Amanda Odoi, the Applicant had filed a suit against the consideration of the LGBTQ+ bill but despite the pendency of the suit, Parliament is still considering the bill.
She then filed for injunction against the Speaker and a Contempt application.
But, the panel after listening to the arguments ruled that no prima facie case has been made to injunct the work of Parliament.
“We have considered the merits of this case and are of the considered view that a prima facie case has not been made to convince us to injunct the work of parliament.
“Neither have we been convinced to injunct an uncompleted work of parliament,” the Supreme Court ruled.
“The issues raised by this application for injunction are matters to be determined by the substantive matter. This application for injunction is dismissed.”
EIB Network’s Legal Affairs Correspondent, Murtala Inusah reports that, the Contempt application against the Speaker has been withdrawn.
