Hearing of the case in which Charles Bissue is seeking for the enforcement of his human rights in an action against the Office of the Special Prosecutor (OSP) has been adjourned to March 11, 2024.
This was because, a new judge is yet to be assigned with the case docket following the retirement of Justice Nicholas Mensah Abodakpi who was then presiding over the case at the Human Rights Court 2.
In Court on Wednesday February 21, Justice Barbara Tetteh-Charway, the presiding Judge at the Human Rights Court 1 sat as a relieving judge.
But, the case was adjourned prior to her sitting.
The suit was initially scheduled for hearing on February 1 2024 but the Court did not sit, necessitating an adjournment to Wednesday, February 21.
Meanwhile the Written Submission on behalf of the Applicant (Charles Bissue) was filed on January 31, 2024.
The OSP’s Written Submission has also been served on Lawyers of the Applicant led by Nana Agyei Baffour-Awuah on February 1, 2024.
The former Secretary to the Inter-Ministerial Committee on Illegal Mining is asking for the following relief from the Human Rights;
a). Quash or cancel the Arrest Warrant issued against the Applicant by the 2nd Respondent to the 1st Respondent.
b). Quash the 1st Respondent’s Notice, declaring the Applicant wanted.
c). Compel the 1st Respondent to comply with the provisions of L.I. 2374 by providing the Applicant with a copy of the Petitions, forming the basis of the investigations being conducted by the 1st Respondent in respect of which the Applicant is deemed to be a necessary person.
d). Prohibit the 1st Respondent, pending the determination of Suit No. J/0328/2023, from applying for Arrest Warrants and hounding the Applicant in the name of investigations.
