Lawyer clarifies central issue in High Court ruling on late musician’s marital status.

Private legal practitioner, Prince Benson Mankotam, has explained that the central issue in the High Court dispute over Daddy Lumba’s marital status was whether the musician’s alleged marriage in Germany to Akosua Serwaa Fosuh was monogamous, not the validation of other partners.

Speaking on Starr Showbiz with Feeling Daddy on Starr 103.5 FM on Saturday, November 29, 2025, the Senior Associate at Edfields Attorneys said the court had to determine if the German marriage met the legal criteria of a monogamous union.

Mankotam clarified that bigamy charges or claims about “side-chicks” could only arise if a proven monogamous marriage existed. Since the onus of proof was on Serwaa to demonstrate that her marriage to Lumba in Germany was monogamous, the case’s outcome largely depended on whether the court accepted her evidence.

“The question was, was the marriage contracted in Germany monogamous? If it had been proven, then Lumba could have been guilty of bigamy,” he said. “But here, the marriage was put in issue, and the evidence provided did not satisfy that requirement.”

He noted that documents submitted as proof, including extracts from the marriage registry, contained inconsistencies such as irregular dates and fonts, which suggested the documents were an afterthought rather than original evidence.

Background

The High Court in Kumasi ruled on November 28, 2025 that both Akosua Serwaa Fosuh and Priscilla Ofori Atta, popularly known as Odo Broni, are lawful wives of the late musician, legally known as Charles Kwadwo Fosu. The court dismissed Serwaa’s claim to be the sole surviving spouse.

Serwaa had argued that a civil marriage allegedly contracted in Germany in 2004 superseded other marital claims. However, the court noted she failed to provide an original or certified true copy of the certificate, instead submitting extracts whose authenticity and consistency were questioned. The defence also argued that Serwaa’s customary marriage had been dissolved and that Odo Broni had lived with Lumba for over 15 years while contracting a valid customary marriage.

The ruling allows both women to participate fully in widowhood rites and funeral and estate matters. Certified copies of the judgment are expected to be released on December 1, 2025.
