AG withdraws application to revoke ex-NAFCO boss’s travel permission after order lapses

The Attorney General has withdrawn its application to revoke former NAFCO CEO Hanan Abdul-Wahab Aludiba's travel permission after the court order allowing him to travel to London expired.

The Attorney General has withdrawn its application seeking to revoke the travel permission granted to the former Chief Executive Officer of the National Food and Buffer Stock Company (NAFCO), Hanan Abdul-Wahab Aludiba.

The High Court in Accra had granted the first accused leave to travel to London, an order which was to elapse on July 12, 2026.

The prosecution subsequently filed a motion on July 8, 2026, praying the court to revoke that leave.

When the case was called on Thursday, July 16, Deputy Attorney-General, Dr. Justice Srem-Sai, prayed the court for leave to withdraw the motion.

“We pray for leave to withdraw the motion considering that the order in respect of which the motion was filed has lapsed as at July 12, 2026,” Dr. Srem-Sai told the court.

Counsel for the accused, former Attorney-General Godfred Yeboah Dame, opposed the circumstances under which the application was filed, arguing that it was intended to frustrate the court order.

“Clearly the application itself was intended to truncate the order of the court to ensure that the first accused was unable to act in accordance with the orders of the court.

“By filing the motion and fixing it on a day after the elapse of the order, the Republic succeeded in subverting the lawful order of the court,” Mr. Dame argued.

He contended that the application could not have been granted having been fixed for hearing after the expiration of the travel order.

Mr. Dame further argued that the prosecution remains in disobedience of the court’s orders, despite the withdrawal.

“As we averred in the affidavit in opposition that we filed, as a result of the action of the Republic in causing the arrest of the accused, they seized the applicant’s money and passport. They are still in disobedience of the orders of the court by seizing the passport of the accused,” he said.

In response, the Deputy Attorney-General rejected the claim that the prosecution fixed the hearing date to frustrate the order.

“It is not correct that the Republic fixed the date for the hearing of the motion. It is common knowledge that the court registry is the authority that fixes dates for motions and not a party,” Dr. Srem-Sai stated.

On the issue of the passport, he said the accused was expected to report on Monday July 14 with a clear indication that he would pick up his passport, but he failed to do so.

“He refused to report,” the Deputy AG told the court.

By Court:

Presiding judge, Justice Francis Apangabonu Achibonga, in his ruling, struck out the motion as withdrawn.

“The motion filed on 8th July 2026 for an order to revoke the leave granted the first accused person to travel to London is hereby struck out as withdrawn,” Justice Achibonga ruled.

Hanan Abdul-Wahab Aludiba, the accused person and his wife Faiza Seidu Wuni were both present.
