Speaker of Parliament, Alban Kingsford Bagbin has indicated that the powers of the judiciary begin where the nose of the parliament starts.
This comes on the back of the Supreme Court dismissing the Speaker of Parliament, Alban Bagbin’s application to set aside its orders staying the ruling that declared four seats vacant on October 17, 2024.
According to the Apex Court, the grounds of Speaker, Alban Bagbin’s application for the Apex Court to set aside its Order on October 18, 2024, has no merit.
The Supreme Court further stated that it would be a misapplication and misinformation for the applicant (Speaker) to say that the Supreme Court has no jurisdiction.
Addressing the media, Speaker Bagbin emphasized that the Constitution clearly outlines the limitations and powers of each branch of government, further highlighting the principle of separation of powers between the two arms of government.
Mr. Bagbin described it as “the power of the judiciary ends where the nose of parliament starts”. He also cited constitutional provisions which give the parliament the autonomy to carry out its duties without external interference.
“Ladies and gentlemen, the powers of the judiciary end where the nose of parliament starts. The constitution is very clear on freedom of speech and of proceedings of parliament. Articles 115 and 116 grant members of parliament privileges and immunities of speech, debates, and proceedings on any matter or thing brought by a member in or before parliament by petition, bill, motion, or otherwise. And I want to quote the two articles to you. Article 115, there shall be freedom of speech, debate, and proceedings in parliament and that freedom shall not be impeached or questioned in any court or place out of parliament,” the speaker noted.
Speaker Bagbin further stated that contrary to claims by the NPP members of parliament that the NDC members of parliament are saboteurs, the NDC MPs cooperate and collaborate to ensure government business moves smoothly.
