The Mortuaries and Funeral Facilities Agency (MoFFA) has given a one-week ultimatum to all mortuaries and funeral facilities operating without licenses across the country to regularize their operations or face immediate closure.
In a statement dated October 22, 2025, the agency said it had observed with concern that several mortuaries and funeral homes continue to operate illegally, contrary to the Health Institutions and Facilities Act, 2011 (Act 829).
According to MoFFA, Section 55 of Act 829 clearly states that “a person who practices in a facility without registering as a practitioner or fails to license a facility commits an offence and is liable to the payment of a fine or the temporary or permanent closure of the facility.”
MoFFA, which was established under Part Two of Act 829, is mandated to license, control, and regulate all facilities connected with the storage, transportation, and disposal of human remains.
“All operators of Facilities and Practitioners are by this notice advised to take steps to regularize their operations or risk closure of their facilities,” the statement warned.
The agency emphasized its commitment to ensuring standards in the mortuary and funeral services sector, assuring that enforcement actions will begin immediately after the one-week grace period expires.
