The High Court in Accra has dismissed Bernard Mornah’s request against the Electoral Commission (EC) for disqualifying him in the December 7, 2024 Presidential race.
Justice Richard Apietu, the presiding judge said at all material times Mr. Mornah and the People’s National Convention (PNC) were “meticulous” when presented with the opportunity to correct their errors.
The Court also said the PNC as a political party has been participating in elections since 1992 and has enough experience to assist its candidate.
Justice Apietu said Bernard Mornah per the records available showed that the Applicants had been given the opportunity by the EC to rectify the errors but they waived that right.
The PNC candidate who was dissatisfied with his disqualification by the EC filed a legal action seeking a judicial review in the nature of Certiorari to quash the EC’s decision to disqualify him.
The Applicants through their lawyer Harod Atuguba said the errors complained about were not specific and were also not given the opportunity the correct them.
But, the EC’s lawyer Justin Amenuvor said the Applicants (Bernard Mornah and PNC) were given the opportunity to correct those anomalies but failed to do so.
Justice Richard Apietu said after listening to the submissions and all available records before the Court, the Court is unable to exercise discretion in favour of the Applicants.
The Court said the Applicants were given the opportunity but failed to do due diligence.
The Court consequently dismissed the action without cost.
