EOCO’s bail condition for Adu Boahene is abuse of power – Atta Akyea

Legal counsel for former National Signals Bureau (NSB) Director, Kwabena Adu-Boahene, has strongly criticized the Economic and Organized Crime Office (EOCO) for imposing what he describes as arbitrary and unreasonable bail conditions on his client.

Speaking in an exclusive interview on GHOne TV with Bernice Abu-Baidoo, Samuel Atta Akyea argued that the bail terms set by EOCO were designed to frustrate his client’s release rather than ensure justice.

“Bail is not meant to punish an accused person but to ensure their availability for investigations and trial. However, the conditions imposed by EOCO are excessive and deliberately crafted to keep my client in detention,” Atta Akyea stated.

He revealed that EOCO had demanded specific assets, including a house in London, as security for Adu-Boahen’s bail, which he described as unrealistic and unfair.

“If an accused person is willing to provide security for bail, why should EOCO reject reasonable options and insist on properties outside the jurisdiction? That is a clear abuse of power,” he argued.

Kwabena Adu-Boahen was arrested at Kotoka International Airport upon his return from abroad on a British Airways flight. His wife was also taken into custody. The arrest follows allegations of financial misconduct and corruption during his tenure as NSB Director.

Authorities claim that Adu-Boahen was involved in illicit financial dealings, leading to the acquisition of multiple properties and significant sums of money. However, his legal team insists that no concrete evidence has been provided to support these accusations.

“If my client was guilty, would he voluntarily leave Ghana and return through Kotoka? He even waited in the airport lounge for his luggage. Does that sound like someone trying to evade justice?” Atta Akyea questioned.

In addition to condemning the bail conditions, Atta Akyea also accused EOCO of violating his client’s right to legal counsel.

“I was denied the opportunity to consult with my client in private. Instead, EOCO officials insisted on listening to and even recording our conversations. That is a clear breach of his constitutional rights,” he stated.

Atta Akyea has urged the judiciary to intervene and ensure that his client receives a fair legal process. He emphasized that bail conditions must be reasonable and must not be used as a tactic to detain individuals indefinitely.

“Justice should not be manipulated. My client is entitled to fair treatment under the law, and we will challenge these oppressive conditions in court,” he concluded.
