Former Black Stars Captain, Asamoah Gyan is set to appeal against the judgement of the High Court for him to pay over GHc1 million to journalist, Osarfo Anthony for malicious prosecution, Starr News understands.
The High Court (Financial and Economic Decision) presided over by Justice Ernest Owusu-Dapaa in his judgement said, the Plaintiff (Anthony Osarfo) was able to discharge the burden of proof.
The Court also held that the manager of Asamoah Gyan (Samuel Anim Addo) set the whole malicious prosecution in motion when he reported the matter to the Airport Police Station and caused the arrest of the Plaintiff.
Consequently, the Court entered judgement in the sum of GHc900, 000 in general damages for the Plaintiff.
The Court, additionally, awarded the plaintiff GHc111, 000 for 111 months that he lost from his job at GHPage.com which was paying him GHc1, 000 monthly at the time.
An agreed cost of GHc60, 000 was also awarded against Asamoah Gyan and his manager, Samuel Anim Addo, bringing the total sum to GHc1, 071, 000.
In 2019, the Accra Circuit Court acquitted and discharged the journalist and three others for allegedly extorting money from Black Stars captain, Asamoah Gyan to stop the publication of rape and sodomy he was allegedly involved in.
The four persons namely; Osarfo Anthony (Arts/Entertainment Writer), Chris Handler (Blogger), Sarah Kwablah (Law Student), and Ekow Micah (Musician) were charged for extortion and conspiracy to commit crime.
However, Her Honour Afia Agbanu Kumador in her ruling on the submission of no case after the Prosecution closed its case, said there was no prima facie evidence for them to open their defense.
Following their acquittal and discharged, Osarfo Anthony, one of the accused, filed a civil action at the High Court for Malicious Prosecution, which he succeeded.
