A private legal practitioner, Yaw Dankwa has described as unfortunate President Akufo-Addo’s comments that it is unacceptable for judges to pronounce judgement based on decision by law court.
President Akufo-Addo has taken a swipe at the judicial service as he says it’s unacceptable for judges to pronounce judgment based on decisions by the law court and cited the same as the ultimate law.
According to him, it is even less acceptable when judges issue orders without providing any justification.
This comes barely a month after the apex court described as unconstitutional the directive from the presidency asking the former auditor general, Daniel Yao Domelevo to proceed on leave as well as the imposition restriction act.
Speaking on Starr Today with Joshua Kodjo Mensah, lawyer Dankwa says it’s unfortunate if the President made those comments.
“The President is a practicing lawyer and has practiced to the highest level in this country, he has been to the Supreme Court so many times. He has been involved in some of these decisions that we apply in court and as of today lawyers argue their case with it.
“So to say that we cannot cite the decision of the Supreme Court as a way to persuade other courts or judges to apply the law effectively is rather unfortunate if that was his actual comments. I have not read the statement but I don’t think that the President with the legal mind will mean that. Maybe he is speaking out of context or so,” lawyer Dankwa stated.
He continued: “I think the law is very clear that the judges interpret the law, it takes effect and we follow it. We all use it as precedent to ensure that there is stability, there is accountability and there is justice and fairness. That is what the law is there for. And that is what we have been doing in this country for many years.”
