The Attorney General has filed an appeal at the Supreme Court seeking to overturn a Court of Appeal decision that suspended the trial of the former Chief Executive Officer of the National Food Buffer Stock Company, Hanan Abdul-Wahab Aludiba.
A three-member panel of the Court of Appeal on Monday, October 19 ordered the High Court to halt the trial pending the determination of an appeal filed by the accused, who is challenging the striking out of his charge sheet.
In a Notice of Appeal filed on October 21, 2026, the Attorney General is challenging the entire ruling of the Court of Appeal.
Among the grounds of appeal, the AG contends that the Court of Appeal erred in holding that a mere challenge to a charge sheet constitutes an exceptional circumstance to warrant a stay of proceedings in a criminal trial.
The AG further argues that the ruling of the Court of Appeal cannot be supported having regard to the record.
The Attorney General has indicated that additional grounds of appeal may be filed upon receipt of the certified true copy of the ruling.
The date for the hearing of the application signed by Deputy Attorney General, Dr. Justice Srem-Sai is yet to be fixed.
