Ofori-Atta is not afraid to face any criminal prosecution – Lawyer Frank Davies replies Kissi Agyebeng

The legal team of former Finance Minister Ken Ofori-Atta has fired back at the Office of the Special Prosecutor (OSP) insisting their client is not afraid to face any criminal prosecution.

Speaking on Starr Today with Tutuwaa Danso on Thursday October 30, 2025, Frank Davies disclosed that Mr. Ofori-Atta is currently out of the jurisdiction receiving medical attention and intends to return if he’s formally charged.

“Kenneth Nana Yaw Ofori-Atta Kuntunkununku is not afraid to face any criminal prosecution. If he’s charged, he will come. He is not scared of prosecution,” he stated equivocally.

“I mean, even as of now, he says he is going to charge him in November. So, why come and waste everybody’s time with this presser?” Davies asked rhetorically.

“Coming to narrate and talk long and needless English is a conviction in itself. He says he’s going to charge him; he should go ahead and stop this gimmicking. Come on, is this the first time the OSP has come out to say something about Ken Ofori Atta?”

This comment follows the OSP’s announcement at a press conference on Thursday, October 30, 2025, that it intends to charge the former Finance Minister and other officials over alleged irregularities in the revenue assurance contract between the Ghana Revenue Authority (GRA) and Strategic Mobilisation Ghana Limited (SML).

Agyebeng described the controversial contract as “a masterful and mischievously crafted scheme” orchestrated by Ken Ofori-Atta. The Special Prosecutor identified the former Finance Minister as “the chief patron”, supporter, and promoter of the SML deal, alleging that both Ofori-Atta and SML management acted “with criminal intent”.

The OSP also disclosed plans to recover more than GHS 125 million from SML in what it described as unjust enrichment.

Mr. Ofori-Atta, who served as Finance Minister from 2017 to 2024, has in recent months been the subject of investigations into revenue assurance contracts in the petroleum and minerals sectors.\

Those expected to face charges alongside Ofori Atta include Ernest Akore, former Chef de Cabinet to the finance minister; Emmanuel Kofi Nti, former Commissioner General of the GRA; Rev. Ammishaddai Owusu Amoah, former Commissioner General of the GRA; and Isaac Crentsil, former Customs Commissioner and General Manager of SML.

Frank Davies further admonished the Special Prosecutor to first resolve his ongoing impasse with the Attorney-General’s Department before pursuing any extradition process or criminal action against his client.
