Private legal practitioner Martin Kpebu has accused the Special Prosecutor, Kissi Agyebeng, of being the “chief architect” behind the departure of former Finance Minister Ken Ofori-Atta to the United States.

​Assessing the Special Prosecutor’s handling of the matter on Accra-based Citi FM monitored by Starrfm.com.gh, Kpebu argued that Mr. Agyebeng failed in his fundamental constitutional duty to alert the public when it became obvious the former Finance minister intended to leave the jurisdiction.

To him, the previous claims by the Special Prosecutor that state security agencies, such as the National Investigation Bureau (NIB), failed to assist him should be dismissed noting that these institutions have formally denied receiving any such requests for assistance.

“He’s the chief architect of this Ofori-Atta departure because look, leave aside—let’s separate the argument—the part where he said he went to National Security, NIB, etc. and they didn’t help him. In any event, those institutions have denied—leave it aside. He said he… so he also knew that Ofori-Atta was going to travel. So assuming, as I said, those institutions have denied what prevented Kissi Agyebeng from informing the nation,” he said.

Kpebu likened the situation to a marketplace scenario at Makola or Mallam Atta, where citizens instinctively raise an alarm—shouting “Julor-eh” or “Ewi”—to prevent a suspect from absconding.

He questioned why a Special Prosecutor, with such a mandate could not perform the simple task of informing the nation of Ken Ofori-Atta’s impending departure.

Kpebu maintained that Mr. Agyebeng’s inability to grasp these renders him “not fit for that office” and therefore demanded his resignation from the office.

He argued that the office of the Special Prosecutor requires a leader who understands the duty to the public, rather than one who remains silent, while high-profile suspects exit the country.

​”A special prosecutor who cannot blow the whistle [and] cannot inform the citizens, which is a constitutional duty…he should leave immediately,” he said.
