Deputy Attorney-General, Justice Srem-Sai, has hinted that his office is preparing to assume control of all criminal cases currently being handled by the Office of the Special Prosecutor (OSP).
The Deputy AG, in a post on his Facebook page, said this transition follows a High Court directive rooted in a challenge to the OSP’s independent prosecutorial authority.
The court’s decision followed a legal challenge involving the Office of the Special Prosecutor (OSP) and one Peter Archibold Hyde where the defense team of the latter argued that, per the Constitution and the Office of the Special Prosecutor Act, the OSP cannot initiate prosecutions without explicit authorization from the Attorney-General.
The High Court, in its ruling, agreed with the defence team of Peter Hyde and ruled that the OSP transfers all its cases to the AG.
The transition process, Srem-Sai said, will begin in the coming days to ensure no disruptions to the judicial process.
“The Honourable Attorney-General has no intention or capacity to disobey or ignore the High Court’s order. Accordingly, the Office of the Attorney-General will, in the coming days, begin to take the necessary steps to give effect to the Court’s order…,” he concluded in a post on his Facebook page.
