The MP for Akwatia is calling for ammendments of Article 88 of the 1992 Constitution to secure the prosecutorial powers of the Special Prosecutor

The Member of Parliament (MP) for Akwatia, Bernard Bediako Baidoo, has warned that the Office of the Special Prosecutor (OSP) will continue to face legal setbacks unless Article 88 of the 1992 Constitution is amended to protect the OSP’s prosecutorial powers.

​Speaking on Starr FM’s morning show, Morning Starr, on Friday, April 17, 2026, the lawmaker argued that the current legal framework leaves the OSP “legally vulnerable.”

​”This office will continue to suffer this defeat… if we do nothing about Article 88… The end to this whole brouhaha is to take the bold step to do something about Article 88 if we feel that the Attorney General should not also be a cabinet minister,” he said.

​The Akwatia MP further noted that the Akufo-Addo administration, which established the OSP, should have taken additional steps to secure the office’s autonomy through an Executive Instrument (EI).

Without such an instrument to grant specific power, he argued, the OSP remains tied to the Attorney General’s discretion for every case.

​”It is either you comply with what the law says or if you are uncomfortable, you exit,” he said.

The Law Maker however said the jurisdiction of the court in recent rulings against the OSP remains “problematic” in his opinion.

The comments of Akwatia MP follow a broader debate regarding the independence of state prosecutors and the perceived conflict of interest when the Attorney General serves as a member of the President’s cabinet.
