J.A. Plant Pool (GH) Limited and its Executive Chairman, Joseph Siaw Agyepong, have rejected claims by the Attorney-General that the company owes the Government of Ghana US$2 million under a contract executed as part of the District Road Improvement Programme (DRIP).
In a statement issued in Accra, the company said it had become aware of a lawsuit filed by the Attorney-General seeking to recover the amount, which the state alleges is owed under a contract awarded to the company.
J.A. Plant Pool described the claim as unfounded and insisted that neither the company nor Dr. Siaw Agyepong is indebted to the government or any of its agencies in relation to the contract.
According to the company, the contract in question was executed on February 12, 2024, following approval granted by the Public Procurement Authority (PPA) on January 10, 2024, for the procurement of equipment and machinery valued at US$178.7 million under the DRIP initiative.
The statement noted that both the PPA approval and the subsequent contract specified the same contract sum and maintained that all obligations under the agreement had been fulfilled.
“The contract has since been fully performed with J.A. Plant Pool duly supplying all machines and equipment to the Government of Ghana. All payments required to be made under the contract have been made in strict accordance with the terms of the contract,” the company stated.
J.A. Plant Pool further expressed concern over what it described as the widespread publication of details of the suit before it had been formally served on the company and its Executive Chairman.
The company argued that the publicity surrounding the case had caused reputational damage to J.A. Plant Pool, the broader Jospong Group of Companies, and their local and international business partners.
The statement also described the Attorney-General’s action as being undertaken in bad faith and disclosed that the company had instructed its legal team to challenge the suit in court.
“J.A. Plant Pool and Dr. Joseph Siaw Agyepong consider the suit filed by the Attorney-General to be in bad faith and have accordingly instructed their lawyers to challenge the suit and ensure its dismissal,” the statement said.
The company urged the public to disregard any suggestion of wrongdoing arising from the legal action and reaffirmed its commitment to transparency, accountability, lawful conduct, and constructive engagement with stakeholders, including the Government of Ghana.
